1. INTRODUCTION

These Terms and Conditions apply to your use of our website and to any order you place with OVERMUSK LTD, trading as OverMusk.

Please read these Terms carefully before placing an order. By using our website or placing an order, you agree to be bound by these Terms.

These Terms apply to sales to consumers in the United Kingdom. If you are buying on behalf of a business, please see section 25.

Nothing in these Terms affects your statutory rights.

If there is a conflict between these Terms and product-specific information shown on a product page, the product-specific information will apply to that product.

4. ELIGIBILITY TO ORDER

By placing an order, you confirm that:

- you are legally capable of entering into a binding contract;
- the information you provide is accurate and complete;
- you are buying for personal use unless we agree otherwise;
- you will not use our products for any unlawful purpose.

Our website and products are intended for adults. If you are under 18, you should only use our website and place orders with the involvement and permission of a parent or guardian.

5. OUR PRODUCTS

We sell fragrance, beauty, cosmetic, personal-care and related lifestyle products.

We try to make sure product descriptions, images, prices, ingredients, sizes and availability information are accurate. However:

- product images are for illustration only;
- packaging, labels or presentation may vary from the images shown;
- colours may appear differently depending on your screen;
- product availability may change;
- product descriptions are not medical advice.

You must read and follow all product labels, instructions, ingredients, warnings and usage directions before using a product.

6. PRODUCT SAFETY AND USE

Products must be used only for their intended purpose and in accordance with the instructions supplied with the product.

For fragrance, cosmetic, skincare or personal-care products:

- use externally only, unless the product clearly states otherwise;
- avoid contact with eyes, broken skin and irritated skin;
- stop using the product if irritation or discomfort occurs;
- seek medical advice if you experience a serious reaction;
- keep products away from children and pets;
- check the ingredient list before use if you have allergies or sensitivities;
- store products as directed on the packaging;
- keep fragrance and alcohol-based products away from heat, flames and ignition sources.

Individual reactions to fragrance, cosmetic or skincare products can vary. If you are unsure whether a product is suitable for you, you should seek professional advice before use.

This section does not limit your rights if a product is faulty, unsafe, damaged, misdescribed or otherwise does not meet your legal rights.

7. PLACING AN ORDER

To place an order, add products to your basket and complete the checkout process.

Before submitting your order, you will have the opportunity to check and correct your order details, including products, quantities, delivery address and payment information.

After you place an order, you may receive an order acknowledgement by email. This acknowledgement confirms that we have received your order, but it does not mean that we have accepted your order.

We accept your order when we send you an order confirmation or dispatch confirmation email. At that point, a contract is formed between you and us.

We may refuse, cancel or limit an order if:

- the product is out of stock;
- we cannot authorise payment;
- there is an error in the price or product description;
- we suspect fraud, misuse or unlawful activity;
- delivery is not available to your address;
- you have breached these Terms;
- we are unable to fulfil the order for reasons outside our reasonable control.

If we cancel an order after payment has been taken, we will refund you for the cancelled item or order.

8. PRICES, TAXES AND PAYMENT

All prices are shown in pounds sterling.

Prices include applicable taxes where required, unless stated otherwise. Delivery charges are shown separately before you place your order.

We may change prices at any time, but changes will not affect orders that we have already accepted.

Payment must be made at checkout using one of the payment methods available on our website.

Payment methods and providers may include:

- Shopify Payments;
- Stripe;
- PayPal;
- Apple Pay;
- Google Pay;
- card networks, banks and fraud-prevention providers connected to those services.

We do not store full payment card details on our own systems.

If your payment is not authorised, we may not process your order.

9. PRICE OR PRODUCT ERRORS

We try to ensure that all prices and product information are correct. However, mistakes can happen.

If we discover an obvious pricing or product error before accepting your order, we may contact you to ask whether you wish to continue at the correct price or with the correct information. We may also cancel the order and refund any payment taken.

If we have already accepted your order and the pricing error is obvious and could reasonably have been recognised as a mistake, we may cancel the order and refund you.

10. DISCOUNT CODES AND PROMOTIONS

We may offer discount codes, promotions or special offers from time to time.

Unless stated otherwise:

- discount codes are valid only for the period stated;
- discount codes may be limited to certain products, customers or order values;
- discount codes cannot be exchanged for cash;
- discount codes may not be combined with other offers;
- discount codes must be entered before checkout is completed;
- we may withdraw or refuse a discount code if it is misused or used in breach of the offer terms.

If you return a product purchased with a discount, your refund will reflect the discounted amount actually paid.

11. DELIVERY

We deliver to addresses in the United Kingdom, unless our website states that other destinations are available.

Delivery options, estimated delivery times and delivery charges will be shown at checkout.

Couriers and delivery partners may include:

- Royal Mail;
- DPD;
- DHL;
- UPS;
- Evri;
- InPost UK;
- other delivery partners used for your selected delivery method.

Delivery times are estimates only, unless we expressly agree a specific delivery date with you.

If no delivery timeframe is stated or agreed, we will deliver your order without undue delay and no later than 30 days after the contract is formed.

You are responsible for providing a complete and accurate delivery address. We are not responsible for delays or failed deliveries caused by incorrect or incomplete address information provided by you.

If a parcel is returned to us because the delivery address was incorrect, incomplete or unavailable, we may ask you to pay reasonable re-delivery costs.

12. RISK AND OWNERSHIP

The products become your responsibility when they are delivered to you, to a person nominated by you, or to a safe place or collection point chosen by you.

If you arrange your own courier or carrier to collect goods from us, the products become your responsibility when they are handed to that courier or carrier.

Ownership of the products passes to you when we have received full payment and the products have been delivered.

13. DELIVERY PROBLEMS

If your order is delayed, missing, damaged in transit or appears to have been delivered incorrectly, please contact us as soon as possible at:

Please include your order number, delivery address and any relevant photos or information.

We may ask you to cooperate with reasonable delivery investigations, including courier checks.

This does not affect your statutory rights.

14. CANCELLING OR CHANGING AN ORDER BEFORE DISPATCH

If you want to cancel or change an order before it has been dispatched, contact us as soon as possible at:

We will try to help, but we cannot guarantee that changes or cancellation will be possible once an order has entered processing or dispatch.

If cancellation is possible and payment has already been taken, we will refund you.

15. YOUR RIGHT TO CANCEL AN ONLINE ORDER

For most online purchases, you have the right to cancel your order without giving a reason.

You have 14 days from the day after you receive your order to tell us that you want to cancel.

If your order is delivered in separate parcels, you have 14 days from the day after you receive the last parcel to tell us that you want to cancel.

To cancel, you must tell us clearly that you wish to cancel. You can do this by emailing:

You may use the model cancellation form at the end of these Terms, but you do not have to.

16. RETURNING GOODS AFTER CANCELLATION

If you cancel your order after the goods have been delivered, you must return the goods to us without undue delay and no later than 14 days after telling us that you want to cancel.

Before sending a return, we recommend contacting us at contact@overmusk.com so we can provide return instructions and confirm the correct return process.

You are responsible for the cost of returning goods when you cancel because you have changed your mind, unless:

- the goods are faulty, damaged, misdescribed or not fit for purpose;
- we have agreed to pay return costs;
- the law requires us to pay return costs.

We recommend using a tracked postal service and keeping proof of postage.

17. REFUNDS AFTER CANCELLATION

If you cancel your order within the legal cancellation period, we will refund:

- the price paid for the returned goods; and
- the standard delivery charge you paid for delivery to you, if any.

If you chose a more expensive delivery option, such as express or next-day delivery, we only have to refund the cost of the least expensive standard delivery option available for your order.

We will refund you without undue delay and no later than 14 days after:

- we receive the returned goods; or
- you provide evidence that you have sent the goods back,

whichever is earlier.

We will refund you using the same payment method you used for the original purchase, unless we agree otherwise.

18. CONDITION OF RETURNED GOODS

You may inspect goods in the same way you would in a shop.

You are responsible for any reduction in value caused by handling the goods more than necessary to establish their nature, characteristics and functioning.

We may reduce your refund if returned goods show signs of use, damage, wear, missing parts, missing packaging or handling beyond what would reasonably be allowed in a shop.

19. PRODUCTS THAT CANNOT BE RETURNED FOR CHANGE OF MIND

Your right to cancel does not apply to certain products, including:

- products made to your specifications or clearly personalised;
- products that are liable to deteriorate or expire rapidly;
- sealed goods that are not suitable for return for health protection or hygiene reasons if they become unsealed after delivery;
- sealed audio, video or software products if unsealed after delivery;
- digital content after download or streaming has started, where you agreed to immediate supply and acknowledged that you would lose the right to cancel.

For fragrance, cosmetic, skincare and personal-care products, this means that we may be unable to accept a change-of-mind return where the product was sealed for hygiene or safety reasons and the seal has been broken, removed or tampered with after delivery.

This does not affect your rights if the product is faulty, damaged, misdescribed or not fit for purpose.

20. FAULTY, DAMAGED OR MISDESCRIBED PRODUCTS

We are under a legal duty to supply products that are as described, of satisfactory quality and fit for purpose.

If a product is faulty, damaged when delivered, misdescribed or not fit for purpose, please contact us as soon as possible at:

Please include:

- your order number;
- a description of the issue;
- photos or videos where helpful;
- your preferred resolution.

Depending on the circumstances, you may be entitled to a refund, repair, replacement or price reduction under the Consumer Rights Act 2015.

If you return a product because it is faulty, damaged, misdescribed or not fit for purpose, we will pay reasonable return costs or provide a return method.

Nothing in these Terms affects your statutory rights.

21. ALLERGIES, SENSITIVITIES AND INGREDIENTS

You are responsible for checking ingredients, allergens, warnings and usage directions before using a product.

If you have allergies, sensitivities, medical conditions, skin conditions or concerns about using a product, you should seek professional advice before use.

If you experience irritation, discomfort or an allergic reaction, stop using the product immediately and seek medical advice if needed.

This section does not limit our responsibility if a product is faulty, unsafe, misdescribed or otherwise does not meet your legal rights.

22. CUSTOMER ACCOUNTS

If customer accounts are available, you may create an account on our website.

You are responsible for:

- keeping your login details confidential;
- ensuring your account information is accurate and up to date;
- all activity under your account unless caused by our failure to use reasonable care.

You must contact us immediately if you believe your account has been accessed without permission.

We may suspend or close an account if we reasonably believe it has been used fraudulently, unlawfully or in breach of these Terms.

23. WEBSITE USE

You must not misuse our website.

You must not:

- use our website for unlawful purposes;
- interfere with the security or operation of the website;
- attempt to gain unauthorised access to our systems;
- introduce viruses, malware or harmful code;
- scrape, copy or extract website content without permission;
- use our website in a way that damages our brand, systems or other users.

We may suspend, restrict or block access to our website where we reasonably believe these Terms have been breached.

24. REVIEWS AND USER CONTENT

If you submit a review, comment, photo, video or other content to us or our website, you confirm that:

- your content is honest and based on your genuine experience;
- your content is not fake, misleading or unlawful;
- your content does not infringe anyone else’s rights;
- your content does not contain offensive, abusive, discriminatory or harmful material;
- you have the right to submit the content.

By submitting content, you give us a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, edit and share that content for website, marketing, social media and business purposes.

We may moderate, remove or refuse to publish content where we consider it inappropriate, misleading, unlawful or in breach of these Terms.

We do not allow fake reviews or reviews submitted in a misleading way.

25. BUSINESS CUSTOMERS

These Terms are mainly intended for consumer purchases.

If you buy products for business, trade or resale purposes, consumer cancellation rights may not apply.

For business customers, to the fullest extent permitted by law:

- we exclude liability for loss of profit, loss of revenue, loss of business, loss of goodwill, loss of opportunity and indirect or consequential loss;
- our total liability for any order is limited to the amount paid for that order;
- you are responsible for ensuring products are suitable for your business purposes.

Nothing in this section excludes liability that cannot legally be excluded.

26. INTELLECTUAL PROPERTY

All website content, including text, images, graphics, logos, product content, designs, layout, branding and other materials, belongs to us or our licensors.

You may use our website for personal shopping and information purposes only.

You must not copy, reproduce, modify, distribute, publish, sell or exploit our website content without our written permission, except as allowed by law.

27. THIRD-PARTY LINKS AND SERVICES

Our website may contain links to third-party websites, platforms, payment services, courier tracking pages or social media pages.

We are not responsible for third-party websites, services, content, policies or practices.

Your use of third-party services may be subject to their own terms and privacy policies.

29. OUR RESPONSIBILITY TO YOU

We are responsible for losses you suffer that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that are not foreseeable.

Nothing in these Terms limits or excludes our liability for:

- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- breach of your statutory rights;
- any other liability that cannot legally be limited or excluded.

We are not responsible for:

- business losses where you are a consumer;
- losses caused by incorrect information provided by you;
- losses caused by your misuse of products;
- losses caused by your failure to follow product instructions or warnings;
- website interruptions or errors outside our reasonable control;
- events outside our reasonable control.

30. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delays or failures caused by events outside our reasonable control.

These may include:

- courier delays;
- postal disruption;
- strikes or industrial action;
- extreme weather;
- fire, flood or natural disaster;
- war, terrorism or civil unrest;
- pandemics or public health emergencies;
- supply-chain disruption;
- customs delays;
- power, internet or telecommunications failures;
- changes in law or government action.

If an event outside our control affects your order, we will contact you as soon as reasonably possible and take reasonable steps to reduce the impact.

31. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The Terms that apply to your order are the Terms in force when we accept your order.

If we make significant changes to these Terms, we will update the date at the top of this page.

32. TRANSFER OF RIGHTS

We may transfer our rights and obligations under these Terms to another organisation, provided this does not reduce your rights.

You may only transfer your rights or obligations under these Terms if we agree in writing.

33. SEVERANCE

If any part of these Terms is found to be invalid, unlawful or unenforceable, the remaining parts will continue in full force and effect.

34. NO WAIVER

If we do not immediately enforce any part of these Terms, this does not mean we have waived our right to enforce it later.

36. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of England and Wales.

If you are a consumer living in England or Wales, you can bring legal proceedings in the courts of England and Wales.

If you are a consumer living in Scotland, you can bring legal proceedings in Scotland or England and Wales.

If you are a consumer living in Northern Ireland, you can bring legal proceedings in Northern Ireland or England and Wales.

Nothing in this section affects any mandatory rights you have under the law of the country or region where you live.
